Yahoo Knowledge’s violation of law – 隨便給罪名

 

Interesting.  I just received a violation notice from Yahoo Knowledge indicating that 您的發言內容有觸犯智慧財產權的疑慮,為避免您觸法,Yahoo!奇摩予以強制移除,若情節嚴重將給予扣點或停權處分.

I added my answer to the comment section later.  I am surprised that my content has violated the copyrights, simply by providing the names of the people, a link to a News article and Youtube.

 

So, where in hell did I violate the copyrights for the answer to be removed?  I asked the question in Yahoo Knowledge.  http://tw.knowledge.yahoo.com/question/question?qid=1008083101962

 

It turns out maybe the problem is with the link to Youtube.  It turns out that providing the link to Youtube maybe considered as a violation of copyrights by the judges in Taiwan , even though the violator of the copyrights may be the one who posted the link on Youtube.

 

It is surprising that copyrights are explained so differently between Taiwan and the US .  If they are the same, Youtube will be bankrupt and no longer exist.

 

In the US, section 512(c) is what protected YouTube.  It is a "notice and take down" system when they host user content. If someone notices an infringing copy of something on YouTube, that person can write a letter to YouTube and demand it be taken down.  Then, so long as YouTube acts "expeditiously" and so long as YouTube wasn't already aware that the material was there, YouTube is in the clear.

Interestingly, the answer I got from the question I posted in Yahoo Knowledge was that I can post the web-link in "Yahoo kimo knowledge" , but they also have the right to remove my answers.

  • 樹大招風,人紅招忌,如果只是link YouTube 就違法,那一大堆張貼別人網站照片和文章的人怎麼辦?抓都抓不完的.整個奇摩就關閉好了.除了亂檢舉人之外,還有人會在你的回答亂挑小毛病,真是什麼人都有.加油!別氣餒喔!但是真不愧是Elisa,還為此去把法律問題搞清楚,真該向你學習處理事情的積極態度.^ ^

    I just don't want to accidentally violate the Taiwanese law.  There are all kinds of people lurking online and it is always a good practice to arm with sufficient knowledge as a protection.  Knowledge is your best weapon.
